We at Rec (“Rec”, “we”, and “us”) respect your right to privacy. This Privacy Policy explains how your Personal Information (as defined below) is used and shared and how you can exercise your privacy rights. This Privacy Policy applies to our website at Rec.com, our emails, our pages or ads on social media networks and any other services that we may provide from time to time (collectively, the “Services”).

1. What Does Rec Do?
Rec enables you (“Rec Users”) to find, book and attend a wide range of fitness, recreational and wellness classes, services, or products offered and operated by parks, gyms, venues or other third parties through our platform (“Partners”). Through the Rec platforms, Rec Users seeking athletic coaching, workshops or classes can be matched with athletic coaches (“Coaches”).
2. What Personal Information Does Rec Collect?
We gather various types of Personal Information from our Rec Users and we use this Personal Information in connection with providing our Services, including the ability to personalize, provide and improve our Services, create your user account and profile, to contact you, to allow other users, Partners or Instructors to contact you, to fulfill your requests for our Services and to analyze how you use the Services. “Personal Information” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we do not own or control or people we do not manage. In this Privacy Policy, we use the term “processing” as it is defined in the California Consumer Protection Act (“CCPA”), which generally covers collection, use, storage and disclosure.
Personal Information You Provide To Us.
There are a variety of different ways you may provide personal information to us, such as:
Account Creation. To create a Rec User account, we collect contact information such as your name, email address, phone number, sign-up city, and account credentials. If you are a Rec Partner, we will ask for your name, address, phone number, email, credit card information, tax identification number, and information about your business, including the names of the instructors and individuals who provide your classes and services and the email addresses of authorized individuals on your account. Once you are registered, we assign you a unique ID number. This ID number allows us to recognize you when you’re signed in. We collect this information only for the accounts you create directly with us and not for any other account you may have with a third party.
Billing Information. If you make a purchase, you will need to provide payment and billing information in order for the payment to be processed. This can include your name, address, phone number, email, credit or debit card information, and any other relevant details.
User-Generated Content. You can choose to add further information to your account, such as birthdate, gender or a profile picture. You may also post or upload information to our platform, such as survey responses, class reviews, Instructor reviews or other content. Anyone can read, collect and use any Personal Information that accompanies your posts or uploads. You may adjust these settings in your account profile; however, please note that your first name and last initial are required in order for your Coach or our Partner to appropriately identify you to fulfill your reservation or booking. Third-Party Data. If you are a Rec User, you should not provide information to us about someone else unless you have obtained the prior consent of the other person for us to receive and use their information, such as for emergency contact or referral purposes. If you would like to invite your friends to use the Services, we will store this information for the sole purpose of allowing you to send your friends referrals, for determining whether your friends use the Services after a referral is sent or to remind your friends of the referral sent on your behalf.
Personal Information Collected Automatically Through Your Use of the Services.
Usage Data. We log usage data when you visit or otherwise use our Services, such as when you view or click on content or ads (on or off our platform), perform a search, browse, or schedule a reservation. The technologies we use to assist with this data collection include cookies, web beacons, tags, scripts and software development kits (“SDKs”). You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of our features. Some Personal Information we collect automatically may include information like internet protocol (“IP”) address, cookies identifiers, device type, unique device identification numbers, browser information, broad geographic location (e.g., country or city-level location), advertising identifiers, operating system information, language and marketing preferences and other technical information. We may also collect other internet and network activity information on our website, including page access times, search queries, and links clicked.
Location Data. We may also collect geolocation data by establishing your approximate location through your IP address. We may use this information to provide, promote, and improve our Services (for example, by showing you classes that are close to your location) and for related reasons, such as fraud prevention and security purposes.
Communications Data. We may send transactional messages to you on behalf of, or initiated by, Partners or Rec Users. For example, we may enable Partners to send text or in-app messages to Rec Users via our Site about an upcoming reservation. Rec receives data regarding such calls, texts, or other communications, including the date and time of the communication and its content.
Personal Information Collected from Other Sources.
Social Media Platforms. If you provide your social network account credentials or otherwise sign into the Services through a third-party site or service, you understand some information in these accounts may be transmitted into your account with us. We also receive information from you when you interact with our pages, groups, accounts or posts on social media platforms. This includes aggregate data, engagement data, awareness data and public profiles. Exactly what information we receive will depend on your settings with the third-party network, but typically we receive your basic public profile information such as your username, email address, age range, gender, chosen language, country, friends list and any other public information.
Our Partners and Coaches. Our Partners and Coaches may choose to submit feedback to us about your use of their facilities or services or may provide us with updates about your reservation. For more information, please see our Community Guidelines at https://www.rec.us/communityguidelines.
Other Third Party Sources. We may receive personal information about you from other sources, such as public databases, strategic and joint marketing partners, people with whom you are friends or otherwise connected on social media platforms, as well as from other third parties. This information may relate to how you interact with our website, products, services, advertisements or communications.
3. What Does Rec Do with the Personal Information it Collects?
Rec uses personal information it receives for several purposes:
Products and Services: We use your information to operate and maintain our Site and the products and services offered through our Site. For example, we use Rec User personal information to fulfill your reservation and purchase requests, to make our Services available to you, to create and manage user profiles and content, to charge you for the Services cost through a payment processing partner, or to communicate with you generally about the Services and related announcements, updates, marketing or promotional materials, including targeted offers and ads.
Personalization: We may track your usage information to personalize and calibrate your Rec User experience using algorithmic recommendations and machine learning. This is how we recommend certain Partners, reservations, instructors or workshops to you based on what we believe you’ll find interesting. California residents have the right to instruct us not to “sell” or “share” their personal information. Sharing User Generated Content: Any information you disclose by publishing on the Rec platform becomes public. We require your first name and last initial to be public in order to verify your eligibility as a Rec User, match you with potential players, and allow your instructor or applicable Partner to provide you with the Services. More information about why we share names and photos can be found in our community guidelines at https://www.rec.us/communityguidelines.
Administrative Tasks: We may use your information to contact you through email, phone, postal mail, notices, and push notifications posted on our Site. We will send you messages about the availability of our Site, a particular Partner, security, customer service, or other service-related issues. We also send messages about the Site, updates, reminders, and promotional messages in accordance with your communications preferences. We may also send you messages about an upcoming reservation initiated by a Partner or a Rec User on your behalf. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.
Customer Support: In connection with customer service inquiries and matters, such as to investigate, respond to and resolve complaints and service issues.
Social: To provide features which allow Rec Users to connect with, and be found by, other Rec Users.
Marketing: We may use your information to market our Services to you either directly or through a marketing vendor. We serve ads through websites, locations, platforms and services operated and owned by third parties. We target our advertising by uploading an encrypted customer list to a third party or by incorporating a tracking technology from a third party onto our Site. The third party then matches individuals who appear in both our data and their data. To opt out of receiving these matched ads, please contact the applicable third parties. We are not responsible for any third party’s failure to comply with opt out requests. We may periodically send you targeted email newsletters or promotional emails. To opt out of these emails, please press the unsubscribe link at the bottom of the email or email your request to privacy@rec.us.
Research and Development: We may use your information to customize and improve your experience with the Services. We may also use your information for research, analytical, recordkeeping, and reporting purposes; to develop and test new products, features and ideas; to learn about our customer base and Site or to evolve and improve our Services.
Security and Investigations: To maintain the security of our Site, including to verify your identity, to investigate or prevent possible fraud or other violations of our Terms of Service or this Privacy Policy and/or in connection with possible attempts to harm Rec Users, Site visitors, Partners or other third parties.We may also use your information to comply with legal, regulatory or contractual obligations and respect to law enforcement requests as required by applicable law, court order or governmental regulation.
Other: We may also use your information for any other business purpose identified at the point of collection or as otherwise set forth in applicable data privacy laws, such as the California Consumer Privacy Act.
4. Who Does Rec Share My Personal Information With?
We may disclose your personal information to the following categories of recipients or in the following circumstances:
Third Party Service Providers: To third-party services providers and partners who provide data processing and other services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our Site, payment card processors, customer support vendors, hosting vendors, scheduling providers, Partners, Instructors, market research, social media platforms and marketing vendors), or who otherwise process personal information for purposes that are described in this Privacy Policy or notified to you when we collect your personal information. Third party analytics and advertising on our Site may collect some personal information and may set and access cookies on your computer or other device. Please note that cookies placed by third parties may continue to track your activities online even after you have left our Services. Our Partners and Coaches: To any Partner that makes available a class, activity or experience you reserve or use through our Site as a Rec User and their third-party providers, so that they can process the applicable reservation or activity and make the Services available to you.
Other Rec Users: Your name, photo and other information associated with your Rec User account will be visible to other Rec Users so that they can search for and connect with you on Rec. You can prevent other Rec Users from being able to search for you by updating your preferences via the Privacy tab in your Account Settings. If you sync your Rec User account to a third-party platform, such as Facebook, or provide us with your contacts, such as those stored on your mobile device, you will be able to see which of your contacts are using Rec. If those contacts are Rec members, they will also be able to see that you are using Rec. If you accept a friend request from another Rec User then, in addition to your name, photo and other information associated with your account, that Rec User will also be able to see your past and upcoming classes, your achievement badges, your friend connections and other profile information (together, “Profile Information”). We may use, communicate, and display your Profile Information next to or in connection with ads, offers, and other messages to your Rec friends - for example, by sending an email to one of your Rec friends to suggest that they join you in class.
Public Users: To anyone who visits the public area of our Site, including via venue and schedule listings, public profiles, reviews, or class ratings. As a Rec User, you should be aware that any content or information you choose to disclose in public areas of our Site can be read, collected, and used by other users, the general public and other sites (including search engines).
Applicable Law or Law Enforcement: To any competent law enforcement body, regulatory, government agency, court, or other third party where we believe disclosure is necessary as a matter of applicable law or regulation, to exercise, establish or defend our legal rights, or to protect your vital interests or those of any other person.
Change in Control: In connection with an actual or potential merger, sale, acquisition, investment, assignment, reorganization, joint venture, or transfer of all or part of Rec’ business, assets, or affiliates, including if Rec should ever file for bankruptcy or a related proceeding, provided that we inform the relevant third-party it must use your personal information only for the purposes disclosed in this Privacy Policy.
Rec Corporate Program: To your program administrator (such as your employer or similar entity), if you participate in any enterprise solutions or the Rec Corporate Program.
Other: To any other person with your consent to the disclosure or otherwise in accordance with applicable law. We may disclose public activities in our RSS feeds, APIs and other distribution formats. Your public activities could then appear on other websites, blogs or feeds. We may also de-identify your personal information so that you are not identified as an individual and provide that information from our partners.
5. How Does Rec Keep My Personal Information Secure?
We use reasonable security procedures and practices appropriate to the nature of the information to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. We monitor our systems for possible vulnerabilities and attacks. However, we cannot guarantee 100% security of any information that you send us.
6. Data Retention
We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

You may correct, amend, or delete your personal information by editing your profile on the Site or contacting us at privacy@rec.us.
You have the right to opt-out of receiving direct marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you. To opt-out of other forms of marketing (such as postal marketing or telemarketing), then please contact us at privacy@rec.us. Please note that any opt-out requests will not prohibit us from sending you transactional or other important non-marketing notices.
Residents in California (and other states where required by law) have certain rights with respect to the personal information collected by businesses. If you are a resident of any such state, you may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:
for certain categories of personal information, the right to request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties;
the right to know the categories and specific pieces of personal information we collect, use, disclose, and sell about you, the categories of sources from which we collected your personal information, our purposes for collecting or selling your personal information, the categories of your personal information that we have either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information;
the right to request that we delete the personal information we have collected from you or maintain about you;

You may designate an authorized agent to make a request on your behalf. You can do this by authorizing your agent to access your Rec account and making a request on your behalf by emailing us at privacy@rec.us. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. If making a request via email, please use the email address linked to that personal information - we can only complete requests on the information linked to your email address. To verify your identity, we will email the email address you provide us and which matches our records and wait for your response. In some instances, we may also ask for additional information.
8. Third-Party Sites
Our Site may contain links to third-party websites or mobile apps, including social sharing features and other related tools. Please be aware that Rec does not control these linked websites or apps and that this Privacy Policy does not apply to any information you give to the owner of these websites or apps. We encourage you to read the privacy policy of any third-party website or app that you visit before you provide them with any information.
9. Your Consent to this Privacy Policy
By using our Site, you agree to this Privacy Policy. We may occasionally update this Privacy Policy. The date of the most recent update of this document will always be displayed at the beginning of this page. We will alert you to any significant changes by placing a notice on rec.com, by sending you an email and/or by some other means. If we decide to use personal information in a manner different from that stated at the time it was collected, we will notify users via email (if an email address has been provided) or display a notice on Rec.com. What are cookies?
